GemRoll Terms of Use

Welcome to GemRoll. These Terms of Use (the "Terms") form an agreement between you and the developer of GemRoll ("we", "us"). By downloading, installing, or using the GemRoll app (the "App"), you confirm that you have read and accepted these Terms in full. If you do not agree, please stop using the App and delete it.

1. The Service

GemRoll is an iPhone photo library cleaner offering:

library scanning and automatic grouping (by person, time, and scene);
similar-photo detection and swipe-based batch cleanup;
people library management: merge, hide, and remove mis-grouped photos;
file conversion: Live Photo flattening and video compression;
an optional monthly cleanup reminder (a local notification, not a subscription).

All analysis runs on your device and does not depend on any network service. We may adjust, add, or remove features through version updates; the features available in the version you use govern.

2. No Account

The App has no account system — every feature is available without registration. Your data and people library are stored locally on your device. Deleting the App deletes all of it, and we cannot recover it for you.

3. Purchases

No subscription — and there never will be. GemRoll offers a single one-time purchase (GemRoll Pro, US$29.99): nothing auto-renews, no recurring charge can ever appear on your account, and we promise never to introduce a subscription. The free version works forever.

GemRoll Pro is a one-time purchase (US$29.99) that unlocks unlimited similar-photo groups, all months in swipe review, video compression, and all future Pro features.
All payments are processed by Apple. We never receive your payment information.
Purchases are tied to your Apple ID and can be restored across devices via "Restore Purchases" (same Apple ID required; Family Sharing members can restore on their own devices too).
Refunds are governed by Apple's refund policy — request one at reportaproblem.apple.com or via Settings → Refund in the App. We honor refunds within 30 days.

4. Your Photos and Data Safety (Important)

The App never deletes photos permanently: every deletion goes through iOS's "Recently Deleted" album, where you can recover it for 30 days. Please note and accept that:

Important: the 30-day window is managed by iOS. If you empty "Recently Deleted" in the Photos app, or 30 days pass, the photos are permanently erased by the system and we cannot recover them. Always keep an independent backup (iCloud or a computer) of important photos before running bulk cleanup. The App is a library cleaner, not a backup tool.

Conversions (Live Photo flattening, video compression) create new files, and compressed videos are lossy — lower quality than the original. Confirm you are satisfied with the result before deleting the original.

5. Your Content and Acceptable Use

All photos, videos, and derived data in your library belong entirely to you. We do not access, obtain, or use them in any way — all analysis happens on your device, with no upload and no network request.

You agree not to use the App to:

process or distribute content that violates applicable law;
collect or analyse other people's facial information without their consent, or infringe their likeness or privacy rights;
infringe intellectual property or other rights of any third party;
reverse engineer, crack, or circumvent technical limitations of the App (except where permitted by law).

You are solely responsible for the consequences of any breach, and you agree to indemnify us for losses caused by such breach.

6. Intellectual Property

All intellectual property in the App, including its interface, icons, code, and documentation, belongs to us. These Terms do not transfer any intellectual property. You receive a non-transferable, non-sublicensable licence for personal use only.

7. Privacy

See the GemRoll Privacy Policy for how we handle your data. In short: the App collects and uploads nothing; face recognition and similarity detection run entirely on your device. The Privacy Policy forms part of these Terms.

8. Disclaimer

The App is provided "as is". Face grouping, similarity judgement, aesthetic scoring, and OCR are algorithmic results and may be wrong or incomplete (for example, mixing two people into one group, or missing a person). Always review before deleting.
We are not liable for data loss caused by device failure, system limitations, your own actions (including emptying "Recently Deleted"), or the expiry of the 30-day window.
We are not liable for service interruptions caused by force majeure, Apple service issues, or third parties.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or punitive damages. Our total aggregate liability to you will not exceed the amount you actually paid for the App (zero for free users).

10. Changes and Termination

We may revise these Terms from time to time. Revisions will be posted on this page with a new date, and material changes will be announced in the App.
If you breach these Terms, we may terminate your licence to use the App.
You may terminate these Terms at any time by deleting the App. Completed purchases are handled under Apple's refund policy.

11. Governing Law and Disputes

These Terms are governed by the laws of the People's Republic of China, excluding its conflict-of-law rules. Disputes shall first be resolved through friendly negotiation; failing that, either party may bring an action before a competent court at the developer's place of residence. Mandatory consumer-protection rules in your own jurisdiction are not affected by this clause.
